Space Debris Rules Spark Regulatory Debate as Satellite Numbers Rise

With thousands of spacecraft now circling our planet, the probability of mid-air impacts has climbed dramatically. Such events could generate clouds of orbital debris capable of making entire sections of space impassable. While space crashes have occurred historically, they remain uncommon events. Today, however, more than 18,000 operational and defunct satellites occupy Earth’s orbit—a figure that has more than doubled over just six years. Most of these vessels cluster within low-Earth orbit, where heightened congestion increases collision risks considerably.
The Federal Communications Commission recently approved updated regulations designed to streamline satellite approvals while introducing fresh safety measures. Industry stakeholders largely endorse these modifications. Under the new framework, satellite operators must exchange real-time positioning information, enabling space traffic controllers to develop comprehensive awareness of orbital objects. Previously, forecasting potential impacts proved challenging and sometimes hazardous.
The Battle for Regulatory Control
Although the FCC’s regulations face minimal opposition on their merits, they have sparked renewed debate regarding which agency should oversee space operations. For decades, the FCC served as the primary satellite regulator, deriving its authority from spectrum management—the radio frequencies enabling wireless data transmission between spacecraft and ground stations. Meanwhile, the commercial space sector’s rapid expansion has prompted legislators to transfer oversight responsibilities to the Department of Commerce.
Proponents of this transition contend that Commerce could better supervise the industry while collaborating with businesses to maintain American competitiveness globally. Bipartisan support exists for this potential shift. In February, both ranking members of the House Science Committee—Republican Brian Babin and Democrat Zoe Lofgren—wrote to the FCC requesting that it withdraw or modify the proposed regulations. Their correspondence emphasized that existing federal statutes lack explicit congressional authorization granting the FCC power over space safety, traffic management, and related non-communications functions.
The commission has yet to issue a formal public statement regarding the letter, nor did it respond to CNN’s inquiry. Republican House Science Committee personnel confirmed on Tuesday that Babin and Lofgren subsequently contacted FCC chair Brendan Carr, asking him to delay the vote and initiate discussions with lawmakers. Despite these appeals, the commission proceeded with a unanimous decision on Wednesday morning.
Industry Leaders Call for Urgent Action
This regulatory uncertainty reflects broader transformations within the space sector. Organizations including SpaceX, OneWeb, and Amazon are deploying hundreds to thousands of additional satellites, raising questions about oversight authority. While Congress and President Donald Trump have expressed preferences for Commerce to assume the space traffic management role, progress has stalled partly due to funding uncertainties. The Department of Commerce has not yet addressed CNN’s request for comment on this matter.
“We’re in a gray area right now,” Tom Stroup, president of the Satellite Industry Association, explained to CNN. He noted that limited efforts have addressed space sustainability and collision prevention. Stroup emphasized that time remains critical given ambitious industry plans. SpaceX, for instance, aims to launch a constellation containing up to one million satellites while developing orbital data centers.
Regarding the FCC’s new sustainability framework, Stroup remarked that such measures “should have been done five years ago.” He added, “One thing is clear: We can’t wait another five years.”
SpaceX has maintained close relationships with the Space Situational Awareness community and demonstrates serious commitment to traffic management. Nevertheless, FCC regulations could establish universal standards that strengthen best practices across the industry. The commission has precedent for guiding the sector toward improved space stewardship. In 2022, the FCC mandated that operators remove dead satellites within five years, preventing defunct spacecraft from becoming long-term orbital garbage.
